Injury, risk & liability waiver
I/We acknowledge and agree to the following terms as a condition of the athlete's participation in any Forge Sports Performance program, session, clinic, or activity (‘Program’):
Nature of activity
The Program involves physical activity, including but not limited to sprinting, agility training, contact work, plyometric exercises, ball skills, and other sport-specific training. Physical activity carries an inherent risk of injury, including but not limited to sprains, strains, fractures, concussion, and in rare circumstances, serious injury or death.
Voluntary participation
I/We confirm that the athlete's participation in the Program is entirely voluntary. I/We understand the risks involved and accept those risks on behalf of the athlete.
Health and fitness declaration
I/We declare that, to the best of my/our knowledge, the athlete is medically fit to participate in the Program and that all medical information provided in this form is accurate and complete. I/We agree to notify Forge Sports Performance immediately if the athlete's health status changes.
Release and waiver of liability
To the fullest extent permitted by law, I/we release and hold harmless Forge Sports Performance, its directors, employees, contractors, coaches, and volunteers (collectively ‘Forge Staff’) from any claim, liability, loss, damage, or expense arising from the athlete's participation in the Program, including any injury, accident, or illness, except where such liability arises directly from the gross negligence or wilful misconduct of Forge Staff.
Supervision and first aid
I/We acknowledge that Forge Sports Performance maintains a minimum coach-to-athlete ratio of 1:15 and that at least one staff member with a current First Aid Certificate will be present at all sessions. I/We acknowledge that Forge staff are not registered medical practitioners and are not qualified to provide medical diagnosis or treatment beyond initial first aid.
Medical treatment authority
In the event of an emergency where the parent/guardian cannot be contacted, I/we authorise Forge Sports Performance staff to: (a) call emergency services (000); (b) consent to emergency medical treatment as reasonably required to preserve the athlete's health and safety. I/We agree to be responsible for all associated medical costs.
Equipment and facilities
I/We acknowledge that equipment and facilities may have inherent risks and that the athlete must follow all instructions given by Forge Staff regarding safe use of equipment and facilities. I/We agree that the athlete will wear appropriate footwear and clothing as directed.
Weather and cancellations
Sessions may be modified, delayed, or cancelled at the discretion of Forge Sports Performance due to adverse weather, unsafe conditions, or other reasonable circumstances. Forge Sports Performance is not liable for any losses arising from such cancellations. Where sessions are cancelled by Forge, a make-up session or credit will be offered.
Conduct
I/We understand that Forge Sports Performance reserves the right to remove an athlete from a session or terminate enrolment without refund if the athlete engages in dangerous, disrespectful, or inappropriate conduct that poses a risk to themselves, other athletes, or Forge Staff.
Queensland consumer law
Nothing in this waiver limits any rights the athlete or their parent/guardian may have under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010) or any other applicable Queensland or Commonwealth legislation that cannot be excluded by agreement.
